Elon Musk’s legal team files a motion for a preliminary injunction against OpenAI

Elon Musk’s legal team has filed for an injunction against artificial intelligence startup OpenAI. The request for a preliminary injunction was filed Friday in the U.S. District Court for the Northern District of California.

In its filing, Musk’s legal team accused OpenAI, CEO Sam Altman, President Greg Brockman, former OpenAI board members Reid Hoffman and Dee Templeton, and Microsoft of anticompetitive behavior. Musk’s lawyers warned that “irreparable harm” would be caused if the injunction was not granted, according to a TechCrunch Report.

Musk’s legal team outlined a number of allegations in its filing. These include that OpenAI allegedly discourages investors from supporting competitors like xAI and that OpenAI profits from “illegally obtained competitively sensitive information,” among other things, thanks to its Microsoft connections. Musk’s legal team also argued that OpenAI and Microsoft are effectively exploiting the CEO’s donations to the AI ​​startup.

“It would be one thing if Microsoft committed anti-competitive behavior again, this time with OpenAI. It would be something entirely different if OpenAI, backed and supported by Microsoft, violated the terms of Musk’s basic donations to the charity. But OpenAI and Microsoft jointly using Musk’s donations to build a for-profit monopoly now specifically targeting xAI is just too much. Plaintiffs and the public need a break.

“OpenAI’s journey from a nonprofit to a for-profit giant is a long one per se anti-competitive practices, blatant violations of its charitable mission and rampant self-dealing. Elon Musk has had his sights set on OpenAI for some time, although his legal successes against the AI ​​startup have been mixed. In July, Musk’s lawsuit against OpenAI was withdrawn, accusing the company of abandoning its charitable mission. The lawsuit was reopened in late summer and two new plaintiffs and several new defendants were added in November.
