Court again rejects Elon Musk’s Tesla pay package worth more than $50 billion

Tesla shares fell in after-hours trading on Monday after news that a Delaware judge had asked for a second time to strike out a multibillion-dollar pay package for CEO Elon Musk.

Tesla (TSLA) stock, which rose more than 3% in Monday’s regular session, lost more than 1% in the late session.

Chancellor Kathaleen McCormick’s decision confirms her own earlier decision invalidating the package worth over $50 billion. That decision followed a shareholder vote in June to approve the pay package. According to reports, Tesla and Musk may appeal the latest ruling.

“The court’s decision is wrong and we will appeal,” Tesla said on X, Musk’s social platform.

Musk, who runs several other multibillion-dollar companies in addition to Tesla and most recently served in the administration of President-elect Donald Trump, is the richest person in the world.

The package, which was challenged on the grounds that it was excessive and approved by a board that was not sufficiently independent from Musk, was defended in part on the claim that Musk should be generously compensated for his work at Tesla engage.
