The jury in Daniel Penny’s manslaughter case may be deadlocked, but Phil Mickelson’s opinion is clear.

The 54-year-old golfer shared a post from political commentator Collin Rugg on becoming increasingly rare.”

Before the most serious charge was dismissed, Penny was on trial for second-degree manslaughter for killing Jordan Neely after putting him in a chokehold on a subway.

Neely later died.

Mickelson agreed with Rugg’s words.

“Agreed. Thank you, Daniel, for serving your country and protecting the many passengers whose lives were threatened by this violent and deranged individual,” Mickelson wrote.

Despite being deadlocked, the judge sent the jury back for further deliberations on Friday morning, but shortly after 3 p.m. they told the court they still could not reach a unanimous decision.

The judge initially ruled that the jury could not deliberate on the second count unless they found Penny not guilty of manslaughter for a reason other than that the chokehold was justified. However, after the jury said it was deadlocked for a second time, Manhattan Assistant District Attorney Dafna Yoran asked that the most serious charge be dismissed so the jury could discuss the lesser charge of involuntary manslaughter, which carries a maximum penalty of four years in prison is punished.

The prosecution wants prosecutors to prove that Penny acted recklessly when he grabbed Jordan Neely in a chokehold. Neely stormed onto the train while under the influence of drugs and threatened to kill passengers during a psychotic episode, according to court testimony.

Neely was a 30-year-old with schizophrenia who said someone was “going to die today” and that he didn’t care about going to prison for life. Penny grabbed him from behind in a chokehold to stop the outburst.

Neely later died. He had an active arrest warrant at the time. He had a high use of K2, a synthetic marijuana drug that acts as a stimulant, and his lengthy criminal record included an alleged attack on a 67-year-old woman in 2021 at another subway station.

The jury will recess over the weekend and deliberate on a lesser charge, involuntary manslaughter, on Monday.
