Alvin Bragg was torched online after the prosecution against Daniel Penny failed

Conservative media and commentators criticized Manhattan District Attorney Alvin Bragg after the failed prosecution of U.S. Marine veteran Daniel Penny this week.

Several experts condemned Bragg for “wrongfully pursuing” Penny, who was charged with manslaughter and involuntary manslaughter for the May 2023 chokehold of Neely in a Manhattan subway car. Neely, a 30-year-old homeless man with schizophrenia had a warrant out for his arrest at the time, and he had stormed onto the train shouting death threats while high on a type of synthetic marijuana known as K2. Penny grabbed Neely from behind in a chokehold during the incident and Neely later died.

Penny was found not guilty on the second count after the first was dismissed the week before.

Amid the relief felt by Penny’s defense attorneys at Monday’s verdict, there was intense criticism of Bragg for bringing the lawsuit against the 26-year-old former Marine in the first place.

“Manhattan District Attorney Alvin Bragg’s attempt to prosecute Perry has failed — and Bragg could, should, pay the ultimate political price for his attempt,” the New York Post editorial board said Monday.

The Post executive argued that “Penny should not have been dragged to court in the first place,” and criticized the prosecutor, saying, “Bragg did it anyway, supporting his radical left-wing, race-obsessed base.”

“Bragg’s prosecutors also relentlessly played the race card at trial, routinely calling Perry ‘the white man’ and imputing racist motives to his actions, even as witness after witness confirmed that Neely’s behavior on that F train had ruined the entire car “Fear and terror was instilled,” the editor said. It also called on Gov. Kathy Hochul, D-N.Y., to “take note and ultimately remove Bragg from office.”

The editors of independent media outlet The Free Press said in a column that Penny’s acquittal “does not nullify Manhattan District Attorney Alvin Bragg’s cynical, false and unwarranted prosecution of a good Samaritan.”

The article goes on to say that this type of unwarranted prosecution was a key part of Bragg’s agenda as district attorney, which led to an increase in crime in New York City as a whole.

“Bragg’s tenure was marked by priorities that did not serve the public and a lax attitude toward criminal behavior that all but guaranteed a rise in crime in New York,” the editors wrote.

“In summary, Bragg has made New York a more dangerous city. “Moreover, while ignoring real crime, he pursued politically convenient targets – such as Daniel Penny – which provoked enormous cynicism among New Yorkers,” they added.

Fox News commentator Gregg Jarrett wrote that the “tragic epitaph” of Penny’s trial is that “the greater societal damage that Bragg’s unjustified case has wrought may be felt by future victims of crime in New York and perhaps elsewhere.” is carried.”

“Knowing that an elected district attorney is committed to prosecuting well-meaning Samaritans will likely discourage him from defending others who are being exploited. The weak and vulnerable among us could become easier targets,” the legal analyst explained.

In a statement obtained by The Daily Caller, Sen. Ted Cruz, R-Texas, condemned Bragg, saying he was an “absolute disaster.”

“First he impeached Donald Trump in a partisan case, and then he impeached Daniel Penny for saving the lives of other subway passengers from a crazed madman who threatened to kill everyone,” Cruz continued.

The lawmaker added: “Penny should sue Bragg for malicious prosecution and hold this rogue Soros prosecutor accountable.”

The Wall Street Journal editorial board stated that Bragg’s lawsuit against Penny “should never have been brought” and argued that the acquittal verdict “is a rebuke to Mr. Bragg, who often refuses to prosecute real criminals but treats Mr. Penny like one.” “Vigilante.”

The panel added that if Penny had been found guilty of one or both charges, it would have “transformed a human tragedy into a greater injustice.”
