Update on charges from the domestic case

A Georgia football receiver who has not played for the Bulldogs in the last eight games waived his formal charges in an Athens court Tuesday afternoon and pleaded not guilty to charges stemming from an October arrest.

That means Colbie Young still has hurdles to overcome to return to the field while facing charges of assault and battery on an unborn child.

Kim Stephens, Young’s attorney, had asked for the charges to be dropped after he said Young’s ex-girlfriend retracted what she had originally told police the night of the incident in a sworn statement shortly after the incident however, did not happen.

Young is unlikely to be selected again for Georgia’s Sugar Bowl game in the quarterfinals of the College Football Playoff on Jan. 1.

His next court date is scheduled for May, but Stephens is requesting that it be moved to Athens-Clarke County State Court. Georgia’s season could last as long as the national championship game on Jan. 20.

Stephens told the Athens Banner-Herald that he has requested that the case be heard on the next jury calendar on Jan. 6.

Young appeared in court wearing a suit and made an appearance that lasted less than three minutes.

He declined to comment to the Athens Banner-Herald outside the courtroom afterward.

The female victim has told Athens-Clarke County Attorney General Will Fleenor that she wants the charges dismissed, Stephens said.

According to an incident report obtained by the Athens Banner-Herald, the woman told police that she suffered a “bruise and discoloration to the bottom of her breast and redness to her right pad” after Young grabbed her from behind and “picked her up.” “She stood up and began squeezing her upper body and stomach very hard” after an argument.

The woman said in the affidavit that the information in the police report “does not accurately reflect what happened on October 8.” She said Young “did not commit any act of violence against me or my unborn child, including but not limited to simple assault or assault on an unborn child.”

According to the National District Attorney’s Association’s 2020 revised Best Practices Guide for Prosecuting Domestic Violence, “Revocation accounts for a majority of prosecutors’ domestic violence cases and occurs in approximately 80% of criminal domestic violence cases.”

It states: “While the prosecutor’s goal is to ensure the safety of the victim and the community and to hold the perpetrator accountable, the victim may wish to continue her relationship with her perpetrator.” This right of the victim to continue the relationship should not be confused with the prosecutor’s obligation to prosecute verifiable cases of abuse.”

Young was reminded that the terms of his bond are that he is not allowed to have contact with the woman.

Young, who was in his first season at Georgia after transferring from Miami, was suspended indefinitely after his arrest Oct. 8 for an incident at his Athens home but was allowed to use the team’s facilities.

He returned to practice two weeks ago after Stephens said an investigation by the UGA Equal Opportunity Office paved the way for him to increase team activities. He said the investigation involved all parties and witnesses in the case and included review of reports and other evidence.
