The Los Angeles district attorney transfers two deputies who sought resentencing

Newly sworn-in Los Angeles District Attorney Nathan Hochman has reassigned two deputies who had petitioned a judge for parole for Erik and Lyle Menendez, who became a cause célèbre after dramatizing their decades-long conviction in the Netflix series “Monsters.” .

Hochman took over as prosecutor last week from the more progressive George Gascón, who was vocal in favor of resentencing or pardoning the brothers. They are currently serving life sentences without the possibility of parole for the 1989 murders of their parents.

Reps. Nancy Theberge and Brock Lunsford filed a 57-page brief Oct. 24 arguing that there was “overwhelming” evidence to rehabilitate the brothers and calling for them to be sentenced to 50 years to life in prison would allow them immediate parole.

Theberge, who headed the resentencing unit under Gascón, will be transferred to the deputy public defender’s office, while Lunsford will no longer be part of the prosecutor’s post-conviction unit, Variety reported Wednesday.

The L.A. District Attorney’s Office did not immediately respond to TheWrap’s request for comment.

Wednesday was also the day Gascón originally scheduled his resentencing hearing, although Judge Michael Jesic has since postponed it to the end of January.

After the election, Hochman told TheWrap in a statement that he still needed to “fully familiarize himself with the relevant facts, evidence and the law” before making a decision about the brothers’ fate.

Celebrities including Ryan Murphy, Kim Kardashian and Rosie O’Donnell, co-creators of “Monsters: The Lyle and Erik Menendez Story,” have argued that they should be pardoned in light of new evidence corroborating the Menendez brothers’ account of horrific sexual abuse should or the possibility of parole was granted.
