The exclusion of Fani Willis from the Trump case has an “overwhelming” impact, a legal expert says

Jonthan Turley, a law professor at George Washington University, said Fulton County Prosecutor Fani Willis was “wrong” to file the Georgia election interference case against President-elect Trump, after a Georgia court ruled against Willis and her team on Thursday excluded from pursuing the case.

Georgia Court of Appeals disqualifies DA Fani Willis and her team in Trump election interference case

JONATHAN TURLEY: The immediate impact of this decision is overwhelming for Willis himself. I mean, that’s basically what this court is saying these cases should not be vanity projects. You know, the lower court told you that you created this appearance of impropriety, and the question the court is asking is why you didn’t walk away. Many of us said at the time that most prosecutors recognized that their continued prosecution was damaging the case and damaging the public interest. Willis simply refused to give up the ghost and insisted that she wanted to play the lead role.

It was wrong to file a lawsuit against Trump. You know, there are some legitimate claims here. You know, she’s charged some people with trespassing or entering restricted areas. These are not particularly serious crimes, but they are crimes. It was wrong to take action against Trump on this basis. She clearly wanted to get involved in law enforcement, and that’s one of the reasons she wouldn’t give up on the case. You know, when this issue was first raised, many of us wrote back then that removing yourself was the right move. You have selected a former lover as lead lawyer. In my opinion, this violates fundamental ethical requirements. He was eventually disqualified by the court. But Judge McAfee gave her a chance to do the right thing. He said, “Look, your behavior here is wrong and you can walk away.” Well, he was talking to the wrong person. She had no interest in leaving. I mean, Lawfare is only valuable if you’re the main warrior, and she wouldn’t give up that position.

The court did not dismiss Trump’s charges outright, but Willis and the assistant prosecutors working in her office now have “no authority to proceed.”

“After careful consideration of the trial court’s findings in its order, we conclude that it erred by failing to disqualify Attorney General Willis and her office,” the filing states. “The remedy devised by the trial court to prevent a continuing appearance of impropriety did nothing to eliminate the appearance of impropriety that existed at a time when DA Willis exercised her broad pretrial discretion over who should be prosecuted and what charges should be filed .”

In an exclusive interview with Fox News Digital, Trump said the “whole case was a disgrace to the justice system.”

“It was launched by Biden’s Justice Department as an attack on his political opponent Donald Trump,” he said. “They took advantage of anyone and everyone, and she got disqualified, and her boyfriend got disqualified, and they stole money and kept traveling.”

Trump said the case “should not proceed.”
