Man charged in the arson death of a woman in the New York subway was deported from the US in 2018

A man charged with murdering a woman who set herself on fire in a New York City subway car was in the United States illegally and had been deported, federal officials said.

Sebastian Zapeta-Calil, 33, a Guatemalan citizen, was arrested on Sunday by New York police in Sunday’s attack, U.S. Immigration and Customs Enforcement officials said.

He entered the country in Sonoita, Arizona, on June 1, 2018, was deported from the United States and returned to Guatemala a few days later – on June 7, 2018, ICE said.

According to ICE, it is unknown where or when Zapeta-Calil illegally re-entered the country.

The man, who lives in Brooklyn, was charged Monday with first-degree murder, second-degree murder and first-degree arson in the subway, the NYPD said.

It was not immediately clear Monday afternoon whether Zapeta-Calil has an attorney.

Federal officials said they would file a request to turn Zapeta-Calil over to ICE once the criminal case against him is complete. This immigration detainee could face deportation.

Around 7:30 a.m. Sunday, an unidentified woman was sleeping on a stationary F train at the Stillwell Avenue subway station when a man set her on fire with a lighter, police said.

After exiting the subway, the suspect sat on a platform bench and an officer’s body camera captured clear images of him that were released via a wanted flyer, New York Police Commissioner Jessica Tisch said.

“Unbeknownst to the officers who responded, the suspect had remained at the scene and was sitting on a bench on the platform directly in front of the train car, and the responding officers’ body-worn cameras provided a very clear, detailed view of the situation.” Murderers,” she said.

Tisch said the man “calmly approached the victim and probably used a lighter to set the victim’s clothing on fire.”

The woman was pronounced dead at the scene.
