Denise Richards’ husband Aaron Phyper sued over alleged fraud

Aaron Phypers is being sued for alleged fraud and breach of oral contracts.

On November 13, 2024, a lawsuit was filed against Phypers, who is married to actress Denise Richards, accusing him of violating an oral agreement regarding treatment at his Malibu spa. Rupert Perry is suing Phypers on behalf of his late wife Elina Katsioula-Beall, who visited Phypers at his center in 2023 because of her cancer.

Katsioula-Beall was diagnosed with sarcoma in 2019 and learned about “a stem cell treatment for her cancer” offered at the Phypers facility. In the documents obtained by PEOPLE, Perry claims that Phypers said the treatment would “cure or at least improve Ms. Katsioula-Beall’s condition.”

It continues: “(Phypers) claimed that the success rate of the treatment was 98% and he was so confident of this that he would refund Ms. Katsioula-Beall and Mr. Perry fifty percent (50%) if it did not work. ) of the money they gave him for treatment.”

According to the documents, Perry and Katsioula-Beall paid Phypers $126,000 and returned for stem cell treatment between July and September 2023. Just a few months later, in December, Perry claimed his wife was told her tumors had enlarged by 25% and they wrote Phyper to inform him and demand $63,000 of their money back.

“(Phypers) ignored her request and instead suggested she undergo another round of treatment,” Perry claims, further alleging that her future requests for money on February 8, 2024, March 7, 2024, and March 29, 2024 were all rejected and ignored .

“On May 21, 2024, Ms. Katsioula-Beall succumbed to her illness and died,” the filing states. “On June 28, 2024, Mr. Perry spoke by telephone with (Phypers), who acknowledged the debt but gave a number of excuses for not paying the $63,000.”

Given that Katsioula-Beall’s cancer only got worse, Perry says her estate is entitled to the reimbursement Phypers promised as a condition of the treatment.

“(Phyper’s) aforementioned misconduct was willful and willful and was committed with the purpose of depriving plaintiff of property and/or legal rights or otherwise causing harm,” Perry claims in the documents while requesting a jury trial. “This despicable conduct subjected plaintiff to cruel and unjust hardship and knowingly disregarded his rights.”

Phypers has not yet filed a response to the lawsuit and it is unclear whether Phypers’ wellness center, called Quantum 360, is still in operation.

PEOPLE has reached out to Phypers for comment.

Phypers’ wellness center has been a topic of conversation in the past – it’s where he and Richards first met. During a 2020 episode The Real Housewives of Beverly Hills, When Richards was a member of the cast, the women asked what Phypers did for a living, but his answer only confused them more.

“Everything you have been taught about the process and how disease works is not true,” he began, before pausing and saying, “I have to be careful.”

In a calmer tone, Richards reminded him, “We already have people following us, be careful.”

“Traditional is not traditional,” he continued. “It’s allopathic. And allopathic means alternative medicine. Take a look. It’s all a measurement of the frequency of the electromagnetic spectrum. I take things apart so you can all heal yourselves – I don’t heal anyone, by the way. I remove blockages, discord and information.”

He then explained how his clinic viewed cancer: “Do you want to know why cancer occurs? Because it protects you from an infection to which your immune system did not respond and you would have died within 12 hours. It’s your best friend who protected you from something that’s about to put a bullet in your head. This is cancer. I’ll prove it all day long,” he said. “We can split an atom with sound, cause a nuclear explosion and kill people. “You can’t figure out if it’s cancer?”
