Georgia Court of Appeals disqualifies prosecutor Fani Willis and her team in Trump election interference case

A Georgia appeals court on Thursday barred Fulton County District Attorney Fani Willis and her team from prosecuting President-elect Donald Trump in his election interference case.

The court did not dismiss Trump’s charges outright, but Willis and the assistant prosecutors working in her office now have “no authority to proceed.”

“After careful consideration of the trial court’s findings in its order, we conclude that it erred by failing to disqualify Attorney General Willis and her office,” the filing states. “The remedy devised by the trial court to prevent a continuing appearance of impropriety did nothing to eliminate the appearance of impropriety that existed at a time when DA Willis exercised her broad pretrial discretion over who should be prosecuted and what charges should be filed .”

The court explained that while it recognized that “an appearance of impropriety is generally not sufficient to justify disqualification, this is the rare case in which disqualification is ordered and no other remedy is sufficient to maintain public confidence.” to restore the integrity of this process.”

“Accordingly, we reverse the trial court’s denial of appellants’ motion to disqualify Attorney Willis and her office,” the filing states. “Because we conclude that the elected district attorney is completely disqualified from handling this case, the assistant district attorneys – whose sole authority to prosecute a case derives from the constitutional authority of the district attorney who appointed them – have no authority to proceed. “” the filing says.

In an exclusive interview with Fox News Digital, Trump said the “whole case was a disgrace to the justice system.”

“It was launched by the Biden DOJ as an attack on his political opponent Donald Trump,” he said. “They took advantage of anyone and everyone and she got disqualified and her boyfriend got disqualified and they stole money and went traveling.”

Trump told Fox News Digital that the case “cannot be allowed to continue.”

“There is no way that corrupt people like that can run a case and then have it taken over by someone else,” Trump told Fox News Digital. “It was a corruption case, so how could it be taken over by someone else?”

“The case must be dismissed because it was corruptly initiated by an incompetent prosecutor who received millions of dollars through her boyfriend – who received it from her – and then they kept going on cruises,” Trump said, referring to Willis’ Relationship with a former prosecutor on her team, Nathan Wade.

“That’s why the case is completely dead,” Trump said. “Everyone should receive an apology, including the wonderful patriots who have been involved for years.”
