Jordan Neely’s father lashes out after Daniel Penny is acquitted in subway chokehold death

Jordan Neely’s father lashed out after being escorted from a Manhattan courtroom after Daniel Penny was acquitted in the subway chokehold of his son last year.

“My son didn’t have to go through this. I didn’t have to go through that either,” a dejected-looking Zachary told reporters after the crucial verdict. “It hurts. It really, really hurts.”

“What should we do, guys? What will happen to us now? I had enough of it,” Zachary said. “The system is rigged. Come on, guys. Let’s do something about it.”

In the courtroom, Zachary was led out as he stared at the audience as applause broke out as the jury announced it had found Penny not guilty of involuntary manslaughter in the May 2023 death of Neely on an F train in Manhattan.

The distraught father immediately got into an argument with someone behind him.

He seemed to have shouted: “You clapped when my son was killed.”

The court officers quickly moved forward and told Zachary, “Get out, get out – you’re out.”

The highly charged and controversial case took a turn last week when Manhattan Supreme Court Justice Maxwell Wiley agreed to a request from prosecutors to drop the top charge of involuntary manslaughter against Penny, a 26-year-old Navy vet, and only the lesser charge of involuntary manslaughter to consider homicide.

The jury announced the acquittal on Monday.

“The jury has now spoken,” Manhattan District Attorney Alvin Bragg said in a statement. “In the Manhattan district attorney’s office, we have great respect for the jury process and we respect their verdict.”

Penny, 26, claimed he grabbed a deranged Neely and put him in a chokehold to protect other passengers after the 30-year-old shouted: “Someone’s going to die today!”
