TikTok seeks an injunction to ban it pending review by the Supreme Court

TikTok, owned by Chinese company ByteDance, has reportedly filed an urgent application for an injunction against a US ban Reuters.

The move is intended to allow the U.S. Supreme Court to review the matter.

The petition was filed with the US Court of Appeals for the District of Columbia and seeks to block enforcement of a law requiring ByteDance to divest TikTok by January 19, 2025 or face a ban.

Passage of the law would result in the shutdown of TikTok in the U.S., impacting more than 170 million monthly users.

TikTok has asked the appeals court to decide by December 16, 2024.

According to a filing with the appeals court, a stay of the law could allow the new U.S. administration to decide on its stance, which could “raise both the impending harm and the need for Supreme Court review,” it said Bloomberg.

The motion states that a pause would not pose an “imminent threat to national security” or “material harm to the government.”

In early December 2024, the appeals court upheld the law requiring ByteDance to sell TikTok in the US by early 2025 or risk a ban in six weeks.

Lawyers for the two companies said the Supreme Court would take the case “and the backlog is high enough to justify the temporary pause needed to allow time for further deliberations.”

Recently, Reuters reported that the Canadian government ordered the dissolution of TikTok’s business in the country, citing concerns about national security risks.

In response to the government’s decision, TikTok expressed its intention to challenge the order in court.
